Justice Dalveer seats ICJ – India Major Diplomatic victory while breaking history of 70 years of UN

Surprising yet with struggle, it will be first time in the 70- year’s history of the UN that the UK will not be positioned on the ICJ and this is the first time that one of the five permanent members of the UNSC lost out to an ordinary member.

With Justice Dalveer Bhandari’s re-election this will be With UK losing place in the world judicial body. This major position and diplomatic gain of India on Monday as its nominee to the International Court of Justice (ICJ) with UK withdrew its candidate Christopher Greenwood. However UK choose to withdraw after it became clear that it would not win the contest in the General Assembly(GA) and it did not have adequate support in the UNSC (United National Security Council) for its attempts to derail the voting process itself.

While it was also recorded that first time in 70- years of UN that not only UK will be on ICJ but  also one of the five permanent member of the UNCS lost out to an ordinary member in a race of position. Again in the stream of creating records first time one sitting member of the ICJ lost to another sitting member.

India’s Diplomatic exceed

India diplomatic has outreached which starts from PM Modi in queue following External Affairs minister Sushama Swaraj , S. Jaishankar ( Foreign secretary ) and India’s permanent Representatives to the UN Syed Akbarruddin was  attracting from support for India in the GA.  While clearing the way moving towards getting 2/3rd of the votes which 128 of them in GA. No judge could have be positioned with cracking of such voting for the ICJ position as the per sources.

IT was quest in which the winning candidate required a majority in both the GA and the UNSC but of 11 rounds of voting until last week ended. India winning in GA and UK winning in UNSC, but as UK announcing its exit from the race in the 12th round but Justice Bhandari received 183 of the 193 votes in the GA and secured all the 15 votes in the UNSC after separate and simultaneous election were held at the UN headquarters in New York. UNSC votes by UK only had 15 in previous rounds leading to delay though India had overwhelming majority in the GA. While it all wanted was to hang from above the voting   process and move to a conference mechanism that has never been used in the history of the UN to break the stalemate. As for this entire stage to pass in need the approval of the UNSC in an open voting while voting for the ICJ is through a secret ballot. Nearing to Monday evening it became quite clear that the UK would not have 9 members to publicly support, As UN  insiders said” Some member who  voted for Britain’scandidate told them that they could not vote for the suspension of the voting process”. Around noon President of the UNSC, GA, Mr. Akbarruddin and British Permanent Representative to the U.N. Matthew Rycroft informally met to take stock of the situation where India made clear not to back off as it already had support and also few made clear to back India.

All other permanent member of the SC –USA, Russia, France and China were seem to have throwing their weight behind fifth said as per media  including Japan which is not permanent member. With progress of evening around 3 p.m. Rycroft wrote letter to presidents of UNGA and UNSC that MR Greenwood (UK) is withdrawing from the contest as to voting continued to Bhandari’s name on the ballot. And became history with the winning of Bhandari to seat of ICJ as UK congratulate him and said to cooperate with India at the UN and Globally. Mr. Rycroft stated at the end of election result” We are naturally disappointed but it was a competitive field with six strong candidates, it the UK could not win in this run-off then we are pleased that it is close friend like India that has done so instead. We will continue to cooperate closely with India here in the UN and Globally.
